Duty of disclosure
The duty of disclosure under insurance law is the statutory obligation of the policyholder as applicant to disclose all known and material facts within the framework of the questionnaire provided by the insurer. Relevant are those facts of risk that are likely to influence the insurer’s decision to conclude the contract or to enter into the contract.
